Terms of Service

1. Operator

The site is run by Tomáš Urban as a private individual, not as a business (“we”); nothing is currently sold on the site. Contact: tomurban@tomurban.one.

2. Your account

• Only a person aged 15 or over may create an account.
• Provide truthful information and keep your sign-in credentials to yourself; you are responsible for activity under your account.
• We may lock an account that violates these terms or is used to attack the service.
• You may request deletion of your account at any time by e-mail from the account address; we handle it within 30 days.

3. Content and copyright

All music, lyrics, artwork, photographs, and texts on this site are the property of Tom Urban or his licensors and are protected by copyright.

You may listen to, read, and view the content for personal, non-commercial use. Copying, redistributing, publicly performing, or using the content to train AI models requires prior written permission.

4. Content on YouTube and social media

The author's videos are also published on his own YouTube channel (Tom Urban, youtube.com/@tomurban-one) and on his own accounts on Instagram, Facebook, X and TikTok. Content on YouTube is subject to the YouTube Terms of Service (https://www.youtube.com/t/terms) and the Google Privacy Policy (https://policies.google.com/privacy); content on the other networks is subject to the terms of the respective service. How we use YouTube API Services for this is described in the Privacy Policy.

5. Your content

Signed-in users may post comments and similar contributions on the site. What you write remains yours; by posting it you grant us a non-exclusive, royalty-free licence to display it on the site.

You agree to keep your contributions lawful and civil: no insults, hate speech, harassment, vulgarity or threats, no spam or advertising, no sharing of other people’s personal data, and no content that infringes the rights of others.

You are responsible for what you post. We may remove content that breaches these rules or the law, and repeated or serious breaches may lead to restriction or termination of the account.

If you believe a post breaks the law or these rules, report it with the button next to the comment or by e-mail to tomurban@tomurban.one. Say which post it is and why you consider it unlawful. We confirm that we received the report and tell you the outcome; when a post is removed or a report refused, its author is told as well, with the reason and a reference to this clause.

The same rules apply to the messages you send the author through the private chat. The chat is not a public forum; we promise neither an answer nor a time to answer. The author is notified of a new message and of a new comment.

In the chat you are answered by the author's digital avatar (Tom Urban AI), a program and not a person; its messages always say so. The real Tom Urban reads the chat and can answer himself at any time. What the avatar sends for processing, and how long messages are kept, is described in the privacy policy.

In the chat: no insults, threats, hate speech or harassment, no spam, and no attempts to impersonate the operator or to talk the avatar out of its rules. The chat is for talking about the author's music and his work.

Breaches of the rules are also assessed by an automated system (see the privacy policy). You get a warning first; if it happens again we close the chat for an hour and then for a day, and on a further breach we lock the account. We tell you in the chat when it is closed. If you disagree, write to tomurban@tomurban.one: a human reviews the decision and we undo it if it was wrong.

Posting comments is open to signed-in fans with a complete profile (name, birthday, listening platform and photo). A new comment is published only after a check: an automated system judges it against these rules and the author may change its decision by hand; we tell you by e-mail whether it was approved or rejected, with the reason for a rejection. An approved comment is machine-translated into the other languages of the site. A comment can be replied to (the same rules and the same check apply to replies; the comment's author gets an e-mail about an approved reply) and given a heart; deleting a comment removes the replies under it as well. Other signed-in fans see your comments with your first name, the initial of your surname and your photo. You can delete your own comments; we may delete any comment that breaks these rules, and we tell you when we do.

Your sharing link counts visits and accounts created through it so the author knows who spreads the music. It brings no rewards, payments or rankings, and you must not use it for spam or unsolicited messages.

Song dedications. By creating an account you acknowledge and agree that the author may dedicate one of his songs to you. In that case the song's page on tomurban.one shows your first name with the initial of your surname, your profile photo (if you have uploaded one) and the author's short message. Dedications are currently visible to signed-in fans; should they ever be shown publicly, we will tell you in advance. A dedication is free of charge, gives no right to any payment or to any rights in the song, and the author is under no obligation to make one. You can ask for a dedication to be removed, or delete your photo in your profile, at any time; we will comply without undue delay.

6. Acceptable use

• No attempts to breach, overload, or disrupt the service.
• No automated scraping or bulk downloading of content.
• No use of the service for unlawful activity.

7. Availability and changes

The service is provided as-is. We may change, add, or remove features; for paid features we will give reasonable notice of substantial changes.

8. Liability

To the extent permitted by law, we are not liable for indirect damages or loss of data arising from use of the site. Nothing in these terms limits liability that cannot be limited by law.

9. Governing law

These terms are governed by the law of the Czech Republic. If you are a consumer in the EU, the mandatory protections of your home country remain unaffected. Consumer disputes can also be resolved out of court with the Czech Trade Inspection Authority (Česká obchodní inspekce, coi.gov.cz, details at www.coi.gov.cz/informace-o-adr/, contact adr@coi.gov.cz), the alternative dispute resolution body in the Czech Republic.

10. Changes to these terms

We may update these terms from time to time to a reasonable extent, for example when the site gains new features or the law changes. The current version with its effective date is always published on this page. We will notify registered users of substantial changes in advance (for example by e-mail). If you do not agree with a change, you may stop using the site and ask us to delete your account; purchases already made remain governed by the terms in force at the time of purchase. Continued use of the site after a change takes effect means you accept the updated terms.
